How Tobique Is Reshaping Offshore Gaming Licensing

For years, Curaçao was the familiar starting point for online gambling companies seeking a relatively accessible international licence. That position has become less straightforward since the island introduced its National Ordinance on Games of Chance (LOK). The updated framework brings stronger oversight and expects licensed businesses to meet requirements involving local operations, technical infrastructure, resident management, and broader compliance controls.

Those changes have encouraged some new operators to examine alternatives. One increasingly discussed option is the Tobique Gaming Licence, issued by the Tobique Gaming Commission under the authority of the Tobique First Nation in New Brunswick. The regime is based on the Tobique Gaming Act 2023 and is intended primarily for online-first businesses rather than traditional land-based casinos.

A Licence Built for Digital Gambling Businesses

The Tobique framework was created through the First Nation’s gaming legislation and is administered by the Tobique Gaming Commission. The Act gives the Commission authority to issue several forms of gaming permission, including direct licences, bookmaker licences, wagering operator licences, lottery promoter licences, pools promoter licences, and gaming software licences.

For most internet-based applicants, the main categories are straightforward:

  • Remote gaming licence: designed for B2C businesses that accept players and manage gaming services directly.
  • Casino and sportsbook software licence: intended for B2B platform companies, game developers, and technology suppliers.
  • Approved vendor status: available to service companies that support licensed operators without running the gambling product themselves.

A broad licence structure can allow one operator to cover several product lines without applying separately for every individual vertical. The exact permission granted still depends on the application, business model, technical setup, and the Commission’s conditions.

Products That Can Fall Within the Framework

The permitted activities may include a wide range of remote gambling products. An applicant can potentially build a portfolio around casino games, live dealer tables, sports wagering, poker, lotteries, Keno, esports, and fantasy sports.

Typical examples include:

  • Online slots, table games, and video poker
  • Live casino games supplied through certified studios
  • Fixed-odds, parimutuel, exchange, and virtual sports betting
  • Esports markets, subject to additional controls where skins or similar assets are involved
  • Peer-to-peer poker rooms, tournaments, and cash games
  • Digital lottery draws, Keno products, and instant-win games
  • Fantasy sports products treated as regulated wagering activity

The scope is not unlimited. Financial products such as Forex spread betting and binary options are generally outside the intended permission. Lotteries involving physical goods can also create restrictions because prize delivery introduces customs, logistics, and cross-border compliance issues.

Market Access Depends on Careful Geofencing

A Tobique licence is not a universal authorisation to operate in every country. Operators must identify prohibited and restricted territories before launch, then use effective geolocation controls to prevent access from those markets. Serving a restricted jurisdiction can become a serious compliance issue even when the customer reaches the website independently.

Commonly cited exclusions include:

  • New Brunswick: the home province of the Tobique First Nation, where operators may need to block local traffic.
  • Highly regulated markets: including the United Kingdom and the United States.
  • FATF high-risk jurisdictions: such as North Korea, Iran, and Myanmar.
  • Sanctioned countries: including Russia, Belarus, and Syria.

Some industry guidance also identifies major European markets such as France, Germany, Spain, Italy, and the Netherlands, as well as Ontario. The restriction lists can change, so operators need a process for monitoring regulatory updates rather than relying only on the list available when the licence was approved.

This makes the jurisdiction more suitable for businesses targeting permitted regions across parts of Europe, Latin America, Asia, Africa, and the Middle East. It is much less suitable for an operator whose main commercial plan depends on Canada, the United Kingdom, the United States, or tightly regulated continental European markets.

Why Operators Compare Tobique With Curaçao

The commercial attraction is often linked to tax treatment, projected launch speed, and the cost of entering the market. The framework is commonly described as offering a 0% gaming tax, unlike regulated jurisdictions where gaming duties can range from roughly 10% to 35%. For a business generating €2 million in annual profit, that difference could represent hundreds of thousands of euros, although the actual saving depends on corporate structure, local taxes, fees, and professional expenses.

Published cost estimates vary. Some sources place the initial government fee between USD $17,500 and $25,000. Other estimates put first-year government charges near €42,000, including a €36,000 issuance fee and a €7,000 compliance charge. Renewal figures are often reported in the range of €16,000 to €25,000 from the second year onward.

Once company formation, legal work, compliance documents, technical reviews, and professional preparation are included, many applicants budget approximately USD $30,000 to $45,000 for the first year. That can be materially lower than the commitments associated with Malta, Gibraltar, or a fully developed Curaçao setup under the newer regime.

Processing time is another point of comparison. A well-prepared application may be reviewed in approximately four to six weeks, while a more cautious estimate is eight to fourteen weeks after document preparation, beneficial-owner checks, and clarification requests are included.

Corporate Setup and Continuing Compliance

Applicants do not necessarily need to incorporate within Tobique. A common arrangement uses one company to hold the gaming licence in a suitable offshore jurisdiction and another entity, often located in a banking-friendly centre such as Cyprus, to manage payment services. The correct structure depends on ownership, banking access, tax advice, payment-provider policies, and the operator’s target markets.

Technical compliance remains essential. Game and platform testing may involve laboratories such as iTechLabs, GLI, and BMM Testlabs. Operators also need certified RNG systems that demonstrate randomness, fairness, and protection against tampering.

Applicants should be prepared to provide policies covering:

  • Anti-money laundering and counter-terrorist financing
  • Know-your-customer checks
  • Responsible gambling and player protection
  • Privacy and data handling
  • Website terms and customer complaints
  • Transaction monitoring and suspicious-activity reporting

Beneficial owners and key individuals can face detailed scrutiny. Individuals holding 10% or more may be required to complete identity verification and provide evidence explaining their wealth and the source of funds used in the business.

Licensed domains are also associated with a closed registry, meaning they are not necessarily exposed through a fully public list. That feature may make broad automated blocking more difficult, but it does not remove the operator’s responsibility to enforce market restrictions or comply with applicable laws.

After approval, the work continues. Licensees may need to submit quarterly financial information, complete annual audits, report ownership changes promptly, maintain current compliance policies, and file renewal materials before the licence expires. Tobique can therefore offer a different entry route from Curaçao, but it is not a substitute for strong governance, reliable geolocation, responsible gaming controls, and ongoing regulatory management.
